Covid Eviction Moratorium Extended

Landlord and tenant groups have been negotiating for some time over an extension to SB 91, also known as the COVID-19 Tenant Relief Act.

Tenants wanted the Act extended through years’ end and beyond while landlords asked for a short extension in exchange for restrictions on local eviction moratoria. Both sides wanted a more efficient rental assistance program.

On June 28, 2021, the Governor signed AB 832, the final compromise between the two sides.

AB 832 not only extends the COVID-19 Tenant Relief Act (CTRA) through September 30, 2021, but it also creates the COVID-19 Rental Housing Recovery Act (the Recovery Act). Despite the improving economy and receding pandemic, the Recovery Act imposes additional eviction restrictions from October 1, 2021 through March 31, 2022.

AB 832 also allows jurisdictions with ongoing repayment periods for rent deferred by a local ordinance to push out their local repayment date until May 31, 2023.

It could also force a six-month delay when obtaining judgments in hundreds of pending unlawful detainers due to poorly drafted statutory language.
